Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Free POS Online (“POS Online,” “we,” “us,” or “our”) at https://freeposonline.com and related services (the “Service”).

1. Agreement to the Terms

By accessing or using the Service, creating an account, or clicking to accept these Terms, you agree to be bound by these Terms and our Privacy Policy at https://freeposonline.com/privacy. If you do not agree, do not use the Service.

If you use the Service on behalf of a business, you represent that you have authority to bind that business to these Terms, and “you” includes that business.

2. The Service

POS Online provides a browser-based point of sale workspace, including tools for products, billing, invoices, refunds, store settings, dashboards, and optional Google Drive sync and optional client-side encryption.

The Service is currently offered free of charge. Features, availability, capacity, and pricing may change. We may modify, suspend, or discontinue any part of the Service with or without notice, subject to applicable law.

3. Accounts and eligibility

You must provide accurate account information and keep your credentials confidential. You are responsible for activity under your account. Notify us promptly through Contact Us if you suspect unauthorized access.

You must be able to form a binding contract and must not use the Service if applicable law prohibits you from doing so. The Service is intended for business use by adults, not by children under 13.

4. Your business data

You retain ownership of the business content you enter into the Service (such as products, sales, invoices, and store details). You grant us a limited license to host, process, transmit, and display that content only as needed to operate the Service you use.

You are responsible for the legality, accuracy, and backup of your business data. Local browser storage can be cleared by you or by browser/device actions. Optional Drive sync stores copies in your Google Drive under your Google account.

5. Optional Google Drive sync

Drive sync is optional and requires your Google authorization. The app requests limited Drive access (drive.file) to create and manage app sync files. You must comply with Google’s terms and policies when using Google sign-in or Drive.

You can disconnect sync in settings and revoke access in your Google Account. We are not responsible for Google service outages, Drive quota limits, or changes to Google APIs or policies.

6. Optional encryption

If you enable encryption, you choose a passphrase and must save the recovery key shown once at setup. Encryption protects local and synced business payloads using keys controlled on your devices.

We cannot recover encrypted data if you lose both the passphrase and recovery key. You must use the same secrets on every device that needs access to encrypted data. Enabling, disabling, or unlocking encryption may require reloading or re-authorizing parts of the Service.

7. Acceptable use

You agree not to:

  • Use the Service for unlawful, fraudulent, or harmful purposes, or in violation of others’ rights.
  • Abuse, overload, scrape, or reverse engineer the Service except where applicable law expressly allows.
  • Interfere with security, authentication, captcha, OAuth, or API mechanisms, or attempt unauthorized access to accounts or systems.
  • Share your account in a way that compromises security, or misrepresent your identity when contacting support.

8. Third-party services

The Service relies on third parties such as Google (Firebase, OAuth, Drive) and Cloudflare (Turnstile). Your use of those services may be subject to their own terms and privacy policies. We are not responsible for third-party services we do not control.

9. Our intellectual property

The Service software, branding, design, and documentation are owned by us or our licensors. These Terms do not grant you ownership of the Service. You may not copy, modify, distribute, or create derivative works of the Service except as allowed by law or written permission.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that data will never be lost. You are responsible for maintaining backups appropriate for your business, including local exports and/or Drive copies if you use sync.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50, SINCE THE SERVICE IS CURRENTLY FREE.

12. Indemnity

You will defend and indemnify us against claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Service, your violation of these Terms, or your violation of law or third-party rights, to the extent permitted by law.

13. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms, if required by law, or if needed to protect the Service or other users. Provisions that by nature should survive (including ownership, disclaimers, limitations, and indemnity) will survive termination.

14. Changes to the Terms

We may update these Terms from time to time. We will update the “Last updated” date and post the revised Terms at https://freeposonline.com/terms. Continued use after changes become effective constitutes acceptance of the updated Terms, except where applicable law requires otherwise.

15. Governing law

These Terms are governed by the laws applicable to the operator of Free POS Online, without regard to conflict-of-law rules, except where mandatory consumer protections in your country require otherwise. Courts in a competent venue for the operator may hear disputes, subject to those mandatory protections.
